Purpose of the Hague Convention

The primary purpose of the Hague Convention is not to determine parental rights or long-term care arrangements. Its objective is to ensure the prompt return of a child to the country of their habitual residence so that the courts of that country can decide any disputes relating to care, contact (link to Care and Contact page), or guardianship.

In practical terms, the Convention:

  • seeks to restore the status quo before the wrongful removal or retention,
  • prevents one parent from gaining an unfair advantage by relocating a child,
  • promotes international cooperation between member states.

Why Prompt Return Is Critical

The Convention recognises that prolonged separation from one parent, particularly where a child is removed to a foreign country, may have serious emotional and developmental consequences.

Returning the child promptly:

  • places the child under the jurisdiction of a court best equipped to assess their best interests,
  • prevents the erosion of the left-behind parent’s relationship with the child,
  • limits the risk of parental alienation caused by unilateral relocation.

South Africa and Hague Convention Countries

South Africa has been a signatory to the Hague Convention since 1996. Most European and Commonwealth countries are also signatories and are legally obliged to cooperate with return applications, provided that:

  • both countries are Convention members, and
  • the wrongful removal or retention occurred after the Convention became effective between those states.

Where these requirements are met, return proceedings are conducted under the Convention framework.

Non-Hague Countries

Where a child has been removed to, or retained in, a country that is not a signatory to the Hague Convention, the legal position is more complex.

In such cases:

  • the High Court of South Africa, as the upper guardian of all children, may exercise jurisdiction,
  • an application may be brought for the return of the child,
  • once a South African court order is obtained, corresponding proceedings may need to be instituted in the foreign country.

This process is often costly, time-consuming, and procedurally demanding, as it may require the appointment of foreign legal representatives and compliance with foreign legal systems.
