  • Ordinarily resident within the court’s area of jurisdiction on that date and have been ordinarily resident in South Africa for a period of not less than one year immediately prior thereto.

Service of Divorce Proceedings Outside South Africa

If the court grants the application, the divorce summons may be served in the foreign country in the manner authorised by the court. This may include service through a foreign sheriff, process server, or other method recognised by the laws of that country.

Once served, the defendant spouse is afforded the prescribed period to defend the action. If the matter is not defended, the divorce may proceed by default. If defended, the matter follows the usual litigation process.
